A low-speed bump in a school pickup line or a grocery store lot rarely feels like much. The cars look fine, the kids seem shaken but okay, and everyone just wants to get home.
That sense of relief is understandable. Still, in the hours and days after even a small collision, South Carolina parents make the decisions that matter most: car seats, doctor visits, and insurance.
What follows takes them one at a time, roughly in the sequence families face them.

Before Leaving the Scene, Gather Four Things
Adrenaline makes memory unreliable. A two-minute habit at the scene saves hours of back-and-forth later.
Capture these on your phone:
- The other driver's name, phone number, insurer, and policy number
- A photo of their license plate and driver's license
- Wide shots of both vehicles, plus close-ups of any damage
- The names of anyone who stopped to help or saw the impact
When someone is injured, or the two drivers tell different stories about what happened, calling law enforcement creates an official record. A report written by a neutral officer carries more weight than two competing stories.
Your Child's Car Seat May Need Replacing
Many parents assume a car seat is fine as long as it isn't visibly cracked. Federal guidance is more specific than that.
The National Highway Traffic Safety Administration says a seat involved in a moderate or severe collision belongs in the trash. A seat can stay in use only when the crash counts as minor, and the agency only calls a collision minor if all five of these conditions hold:
- The vehicle was drivable afterward
- The door closest to the car seat wasn't damaged
- Nobody in the car was injured
- The airbags, if the car has them, didn't go off
- The seat itself shows no visible damage
If even one item doesn't fit, the seat should come out of rotation. The full criteria are spelled out in the NHTSA's replacement criteria for seats involved in a collision, and the seat manufacturer's manual may add its own rules.
Keep the receipt for any replacement seat. It is a legitimate crash-related expense, and the at-fault driver's insurer is often asked to cover it.
Kids Don't Always Show Injuries Right Away
Young children struggle to describe pain. A sore neck may come out as crankiness, and a mild head injury may look like an unusually long nap.
Over the next few days, watch for:
- Headaches, dizziness, or complaints that "things look blurry"
- Changes in sleep, appetite, or mood
- Stomach pain, especially where a seat belt crossed the body
- New clinginess, nightmares, or fear of riding in the car
A pediatrician visit within a day or two is a sensible step even when nothing seems wrong. It gives your child a baseline check, and it creates a dated medical record if symptoms appear later.
Emotional effects deserve attention too. Children often process a scary moment slowly, and paying attention to their overall well-being matters as much as checking for bumps. This idea runs through articles about kids' health as more than height and weight, and it applies after a crash as well.
How South Carolina Insurance Rules Shape What Happens Next
South Carolina handles car crashes through a fault-based system. The driver who caused the crash, through their liability insurer, is generally responsible for the other family's losses.
State law sets minimum liability limits that every policy issued here must carry:
| Coverage | Minimum Required in South Carolina |
| Bodily injury, one person | $25,000 |
| Bodily injury, two or more people | $50,000 |
| Property damage | $25,000 |
Those figures come from S.C. Code § 38-77-140. They are floors, not targets. A single emergency room visit for a child, plus a replacement seat and a rental car, can use up a surprising share of a minimum policy.
Your own policy matters too. Uninsured and underinsured motorist coverage can step in when the other driver carries too little insurance or none at all, so it is worth checking your declarations page now rather than after a crash.
Timing Is Tighter Than Most Families Expect
Insurance adjusters may call within a day or two. Being polite is fine, but nobody is required to record a statement for the opposing insurer on the spot, and early settlement offers often arrive before anyone knows how a child will recover.
A car crash injury lawsuit in this state usually must be started within three years, under S.C. Code § 15-3-530. Crashes involving a government vehicle or a public road defect follow the South Carolina Tort Claims Act instead, which usually sets a two-year limit under § 15-78-110.
A few practical habits make any claim easier:
- Keep every bill, receipt, and appointment note in one folder
- Write a short daily note about your child's symptoms for the first two weeks
- Save photos of bruises as they change color
- Track missed work and school days
The Property Damage Side
Body shop estimates often come in higher than expected once a bumper is removed and hidden brackets or sensors turn up bent. Ask the shop to send supplemental estimates directly to the insurer, and keep copies. If the family car will be in the shop for days, ask whether the claim includes a rental with room for every car seat the kids need.
Knowing When to Get Advice
Most fender benders end with a body shop visit and a new car seat. Some don't. If a child's symptoms linger, if the other driver disputes fault, or if the insurer's numbers don't add up, McWhirter, Bellinger & Associates SC personal injury attorneys are one place families turn for a clearer picture of where things stand. Many families find that an hour of answers removes weeks of second-guessing.
A Calm Plan Beats a Perfect One
Nobody handles every step flawlessly after a crash with kids in the car. What helps most is a short list: document the scene, check the car seat against federal criteria, get the kids looked at, and keep paperwork in one place. Those four habits protect both your children's health and your family's options.
